Judge Orders Temporary Shutdown of Dakota Access Pipeline

A U.S. District Court Judge has ordered the temporary shutdown and emptying of the Dakota Access Pipeline.

 
 

U.S. District Judge James Boasberg concluded that a 30-day shutdown and an environmental review was necessary.  The $3.8 billion pipeline has been in operation for three years, crossing beneath the Missouri River and Lake Oahe and north of the Standing Rock Sioux Reservation.  The tribe fears pollution and environmental harm.

 
 

“Clear precedent favoring vacatur during such a remand coupled with the seriousness of the Corps’ deficiencies outweighs the negative effects of halting the oil flow for the thirteen months that the Corps believes the creation of an EIS will take,” Boasberg wrote.
