Man is Suing Popeyes for Running Out of Chicken Sandwiches

The Times Free Press has reported that a Chatanooga man is suing Popeyes for running out of chicken sandwiches.

Popeyes new chicken sandwich exploded in popularity as many on the internet claimed it was better than Chick-fil-A‘s chicken sandwich, sparking a huge debate.  In fact, the new sandwich gained so much popularity that the restaurant underestimated the demand and sold-out nationwide.  Popeyes will re-stock and return the sandwich to menus eventually, but now a man is suing the company for deceptive business practices in the meantime.

Craig Barr is accusing the company of false advertising and deceptive business practices.  He claims the shortage has cost him “countless time driving” from location to location trying to find a restaurant that wasn’t sold out of chicken sandwiches  On one drive, he blew a tire and cracked his $1,500 rim.  And, Barr was even swindled out of $25 by a guy on Craigslist who told him he could get a sandwich.

“I can’t get happy; I have this sandwich on my mind. I can’t think straight,” he told the Times Free Press on Thursday. “It just consumes you.”

Apex Marketing Group estimated the online hype over the sandwich was worth about $65 million in marketing.

“It’s totally deceptive. Who runs out of chicken? It’s a big fiasco. Someone has to stand up to big corporate,” said an agitated Barr. “Everyone is captivated by these sandwiches. They’ve got everyone gassed up on them.”

Popeyes did not return a request for comment from the Times Free Press.
